Real Estate Question

What is the longest any of you have ever had to wait to get a deposit back after moving out of an apartment?

A week? Two weeks? A month? Longer?

Just curious.

I'm just wondering if I'm being unreasonable with my former landlords for requesting (at least once a week every week since moving out) a simple update on the status of the return of my deposit.

I've gotten tax returns quicker than this.

what does your lease say about the return of the deposit?

    "...within 45 days after the end of the tenancy, Landlord shall return the security deposit to Tenant..."

    So technically they still have some time, I just question WHY any tenant should have to wait so long since the deposit exists to:

    A) protect the Landlord against any damages that may have occurred (which there were none)
    B) the need to clear any debris left by me (which there was none)
    C) non-payment of rent (again, not an issue as I was all paid up)
    D) failure to return all keys to the Premises of the Landlord (which I did five minutes after I moved all my stuff out.)

    So all of the things that the deposit is supposed to protect against were non-factors. The way I left that place, the new tenant could have moved in immediately after I moved out.

      It's in their best interest (literally), to hold your deposit for that full term. You may have met all the conditions required, but the only one they have to meet is within 45 days. If they did rent it immediately after you moved then there making money of the place and your money.

            i think it is a fixed rate. the landlord might end up with 2-3 bucks extra but honestly i think the reason why landlords are slow to return deposits is that they are, like most people, lazy, and don't do anything til they HAVE to. even moreso in "the land of pleasant living".

              you're right, the broader reason for the large 45 days is so they don't have to be in a rush to do anything.

                Being very (very!) generous to the rental company, if they're managing a lot of properties they might need that time to coordinate the inspection, cleaning, and then accounting. It would be nice if they'd told Reggie ahead of time "you know it really is gonna take 45 days like it says in the lease."

                  Well the accounting must take a whole lot of time because it's been inhabited since about four days after I moved out (I know this because one of the people in the office said the new tenant would be moving in around the fourth of last month...also because I bugged the place.)

check the local laws. In SF for example, they have 3 weeks to return it... WITH INTEREST if they haven't been paying it to you yearly. Otherwise you can take it to court and get a little extra for your efforts.
